EU Responsible Person Services for GPSR Compliance

 – Available at TBA Global

With the closure of the Amazon Responsible Person (ARP) service earlier this year and the introduction of new regulations under the General Product Safety Regulation (GPSR), it has become more crucial than ever to ensure your business is fully compliant with all EU safety legislation.

Why is GPSR Important for Non-EU Businesses?

For businesses outside the EU looking to place products on the European market, understanding and fulfilling these new requirements is essential to avoid costly disruptions, potential penalties, and the possibility of your products being removed from sale.

Closure of the Amazon Responsible Person (ARP) service

Amazon closed their ARP service on March 31, 2024.

  • Sellers who previously relied on Amazon for their Responsible Person representation now need to appoint an alternative Responsible Person.

Why do I need a Responsible Person in the EU?

The EU currently mandates that all CE-certified products placed on the EU market by a non-EU business must have an appointed Responsible Person based within the EU.

  • Without a Responsible Person, you can’t sell your products!
  • The Responsible Person is responsible for representing the non-EU business and complying with all relevant product safety requirements, including acting as a point of contact both for customers and any relevant local authorities.

For EU-based businesses that may still want support with compliance, appointing a Responsible Person can also be beneficial, allowing them to outsource compliance management to a dedicated professional – in the long-run, this could save both time and resources!

What about the  General Product Safety Regulation?

The introduction of the GPSR marks a significant development in EU product safety legislation.

  • The requirement for a Responsible Person extends beyond CE-certified products.
  • Starting December 13, 2024, many non-food products that didn’t previously need CE certification will now require a Responsible Person.

What Does This Mean?

This regulatory expansion means that businesses selling items such as electronics, toys, furniture, and many other consumer goods will need to assess whether their products now fall under the new rules, and appoint a Responsible Person if required.

What should I do?

Compliance is essential to keep your business running smoothly and to avoid disruptions.

  • Online businesses risk having non-compliant products removed from marketplaces, impacting sales and reputation.
  • Importers face potential shipment rejections, seizures, or destruction of goods at customs.
