EU Batteries Regulation: Is Your Business Ready for the 2025 Deadline?

Did you know? A new EU-wide Batteries Regulation is being phased in, and key enforcement will begin on 18 August 2025.

If you sell battery-powered products in the EU, it’s critical to understand your responsibilities now to avoid fines, product delisting, or involuntary registration by platforms like Amazon.

 

What Is the EU Batteries Regulation?

The new EU Batteries Regulation (2023/1542) came into effect on 17 August 2023, replacing the older Batteries Directive. Unlike the previous framework, which left compliance rules up to individual countries, the new Regulation harmonises rules across all EU Member States.

It also significantly expands the scope of regulated battery types:

  • 🔋 Portable batteries

  • 🚗 EV (Electric Vehicle) batteries

  • 🏭 Industrial batteries

  • 🛴 LMT (Light Means of Transport) batteries

  • 🔑 SLI (Starting, Lighting, Ignition) batteries

And it’s not just about EPR anymore—additional product safety and sustainability requirements are being phased in gradually.

 

What’s Changing from 18 August 2025?

Starting 18 August 2025, online marketplaces like Amazon will be obligated to:

  • ✅ Check that sellers are properly registered under Batteries EPR

  • ✅ Gradually verify other regulatory requirements as they come into effect

Non-compliant sellers risk:

  • Having listings removed

  • Being forcibly enrolled into platform-run compliance services

  • Facing legal and financial penalties

What Should You Do to Stay Compliant?

1️⃣ Apply for Batteries EPR Registration

Sellers must register under the Batteries EPR scheme in relevant countries (e.g. France, Germany, Italy, Poland, Spain). A valid EPR number must also be uploaded to your sales platform for verification.

2️⃣ Ensure CE Certification for Entire Products

Under the new Regulation, CE certification is required not only for the battery but for the entire product containing it. This marks a major change from past practices.

3️⃣ Appoint an EU Responsible Person (For Non-EU Sellers)

If your business is based outside the EU, you must appoint a Responsible Person within the EU to handle compliance under both the Batteries Regulation and the General Product Safety Regulation (GPSR).
