Whether you’re subject to EPR regulations will depend on the country you trade in. Generally, you’re considered a Producer under EPR rules if you:

Manufacture products that are subject to EPR requirements in the relevant country, or

Import products that are subject to EPR requirements into the relevant country, or

Sell products that are subject to EPR requirements in the relevant country and your company is not based in that country. E.g., if you sell electronic toys to customers in Germany and France from China, you’re considered to be a Producer and are therefore expected to be EPR-compliant in both Germany and France.

Extended Producer Responsibility is an environmental policy approach which requires producers to take responsibility for the entire lifecycle of their products, including waste disposal and recycling.

This means that businesses trading in physical goods will need to contribute towards regional disposal and recycling schemes for their products.

Although the EU has set general EPR rules (EPR Directives), there is no EU-wide registration scheme.  You will need to apply in each Member State that you are trading in, according to their individual requirements.   If you’re unsure whether you need to apply, please check with us for more details. 

Changes to German packaging and electrical waste legislation have imposed control duties on marketplaces such as Amazon and eBay. Consequently, operators are now restricting their marketplaces to sellers who can demonstrate compliance with EPR regulations. Therefore, you will need to add/upload your EPR documentation to your seller account. Proof for packaging was required by July 2022, for electrical appliances by January 2023, and for single-use plastics (SUP) by January 2025.
