New EPR compliance measures implemented on Amazon UK
What are the changes to EPR regulations?
Starting from the 1st April 2024, Amazon UK will launch a ‘Pay on Behalf’ scheme for the UK marketplace, in line with new EPR Packaging regulations introduced by the Packaging Waste (Data Reporting) (England) Regulations 2023.
Businesses are deemed as being covered by the Packaging Waste Regulations if:
1) They meet all of the following requirements:
▪ Are an individual business/subsidiary/group based in the UK (but not a charity)
▪ Annual turnover of £1 million or more
▪ Used more than 25 tons of packaging in 2022
▪ Perform any form of packaging activities
And
2) They engage in any of the following activities:
▪ Supply packaged goods to the UK under their own brand
▪ Place the goods in packaging that is not branded when supplied
▪ Import packaging products into the UK
▪ Sell products through an online marketplace (e.g. Amazon UK)
▪ Rent/lease reusable packaging
▪ Supply empty packaging
Do I need to take action?
Under these regulations, Amazon UK itself is deemed as under the EPR regulations, if it is facilitating sales on behalf of non-UK businesses.
This means that if your business is not established in the UK, Amazon UK is still liable to calculate and declare EPR contributions on your behalf. Sellers will therefore be automatically enrolled into the ‘Pay on Behalf’ programme so that the EPR contribution fees can be passed on.
