EU Product Compliance Regulations Introduced (GPSR)

If you’re selling in the European Union (EU), you may have recently received an email from Amazon advising that you will soon need to comply with the requirements of the General Product Safety Regulation (GSPR) (2023/988).

The GPSR will enforce a requirement for businesses to nominate a Responsible Person (EURP) for any products being marketed within the EU.   

The EURP must also be located within the EU, and be available as a contact point for any compliance issues. 

Where necessary, the EURP will also be responsible for communicating with the appropriate regulatory authorities.

What has changed about the GSPR?

Compliance measures previously introduced by the General Product Safety Directive (GPSD) have been expanded, and new measures have also been introduced.

You’ll also need to provide expanded product safety information where applicable.

Crucially, the new expanded requirements will now apply to all non-food products, not just products that require CE certification.  

Online marketplaces will also be obligated to check that you have correctly appointed an EURP.  

With these changes to the GSPR, what do I need to do?

The GPSR will also require online marketplaces to ensure that their sellers are compliant.  

You should: 

▪ Ensure that any products currently sold in the EU/Northern Ireland are already compliant with existing regulations (GPSD)

▪ Nominate an EURP for products sold in the EU 

Additionally, you should ensure that you comply with the following new requirements: 

Product Labelling Requirements:

▪ Include the details of the EURP

▪ Include a type/batch/serial number

▪ Include appropriate safety warnings, in the language of the country of sale 

 

Product Listing Requirements (on your website and/or online store): 

▪ Show the contact details of the EURP

▪ Provide a product picture that identifies the product properly

▪ Provide appropriate safety warnings, in the language of the country of sale

If you’re unable to comply with the new regulations, the online marketplace may suspend your product listings and/or your selling account.
